By creating an account or using Chirpy's Classroom, you agree to these terms. If you are a parent or teacher creating an account on behalf of a child, you confirm you have the legal authority to do so.
1. Acceptance of terms
These Terms of Service ("Terms") form a binding legal agreement between you and Three Baby Birdies / Iris Scarfone ("we," "us," "our"). By accessing or using our website (threebabybirdies.com) or our AI-powered learning platform (Chirpy's Classroom), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the service.
2. Eligibility & account registration
- You must be at least 18 years old to create an account.
- Parents create accounts on behalf of their children (ages 3–12). Children do not register directly.
- Teachers may create classroom accounts for use with their students.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- You must provide accurate and complete information during registration.
- One account may manage multiple child profiles, but may not be shared between unrelated families.
Parent PIN: Chirpy's Classroom includes an optional Parent PIN feature that locks the app so children cannot navigate away. We strongly recommend enabling it. Set up your PIN in-app →
3. Subscription plans & billing
Chirpy's Classroom is offered on the following subscription plans:

- Billing is processed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
- Prices are in US dollars and subject to applicable taxes.
- Message limits reset on your billing anniversary date each month. Unused messages do not roll over.
- We reserve the right to change pricing with 30 days' notice to active subscribers.
4. Refunds & cancellation
- Free trial: No charge is applied during the 3-month free trial. You may cancel at any time with no obligation.
- Monthly subscriptions: You may cancel at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months.
- Refund requests: If you experience a technical issue that prevents you from using the service, contact us within 7 days and we will review your request in good faith.
- eBook purchases: Due to the digital nature of the product, eBook purchases are non-refundable once the download link has been accessed.
To cancel your subscription, email iris@threebabybirdies.com. We do not currently offer in-app cancellation, but we process all requests promptly.
5. Acceptable use
You agree not to:
- Use the service to generate, share, or solicit harmful, abusive, illegal, or inappropriate content
- Attempt to circumvent, reverse-engineer, or interfere with the platform's content safety filters
- Use the service for any commercial purpose other than legitimate classroom instruction
- Share your account credentials with users outside your family or classroom
- Attempt to extract, scrape, or copy Chirpy's AI responses at scale
- Impersonate another user, parent, teacher, or staff member
Content safety: Chirpy's Classroom includes AI-powered content moderation. Attempts to elicit inappropriate content will be blocked, logged, and may result in account suspension.
6. Content & AI responses
- Chirpy and Mama Bird are powered by the Claude API (Anthropic). While we apply content safety filtering, AI responses are generated dynamically and may occasionally be imperfect.
- We do not guarantee that AI responses are educationally accurate, complete, or error-free. Parents and teachers should use their judgment when reviewing learning outcomes.
- Chat messages you send may be reviewed by our team (not Anthropic) in aggregated, anonymized form to improve content safety and response quality.
- You retain ownership of any content you submit. By submitting it, you grant us a limited license to process it for the purpose of generating AI responses.
7. Intellectual property
All content on this website and within Chirpy's Classroom, including the Three Baby Birdies book text, illustrations, character designs, brand name, logo, and platform code, is the intellectual property of Iris Scarfone and Three Baby Birdies, protected by copyright law.
- You may not reproduce, distribute, or create derivative works from our content without written permission.
- Teachers may use Chirpy's Classroom output for legitimate classroom instruction but not for resale or redistribution.
- The name "Chirpy," "Mama Bird," and "Three Baby Birdies" are brand identifiers and may not be used without permission.
8. Termination
We reserve the right to suspend or terminate any account that violates these Terms, with or without notice. Grounds for termination include but are not limited to: abuse of the content safety system, fraudulent billing, or any illegal activity.
You may delete your account at any time by emailing us. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.
9. Limitation of liability
To the fullest extent permitted by law, Three Baby Birdies and Iris Scarfone shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
The service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
10. Governing law
These Terms are governed by the laws of the United States and the state in which Iris Scarfone operates. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association.
